The seller operates the online store at drinkaini.com (the “e-shop”).
2. General provisions
These terms and conditions (the “Terms”) govern the mutual rights and obligations of the seller and the buyer arising in connection with a purchase contract concluded through the e-shop.
The Terms are governed in particular by:
- Act No. 89/2012 Coll., the Czech Civil Code (the “Civil Code”)
- Act No. 634/1992 Coll., on consumer protection
- Act No. 110/2019 Coll., on the processing of personal data
- Regulation (EU) No 1169/2011 on the provision of food information to consumers
The buyer is a consumer within the meaning of Section 419 of the Civil Code — a natural person not acting in the course of their business activity.
3. Order and conclusion of the contract
By completing the order form and clicking the “Pay” button, the buyer submits a binding offer to conclude a purchase contract (the order).
The purchase contract is concluded at the moment the seller confirms the order — by sending a confirmation e-mail to the address provided by the buyer.
Before submitting the order, the buyer can review and correct all entered data. The seller reserves the right to refuse an order due to unavailability of goods, suspected misuse, or incorrect information.
The individual steps leading to the conclusion of the contract are apparent from the ordering process in the e-shop.
4. Prices and payment terms
All prices listed in the e-shop are final. The seller is currently not a VAT payer; the price of the goods is the one valid at the moment the order is submitted.
Payment methods:
- Card payment (Visa, Mastercard) via the Stripe payment gateway
- Apple Pay / Google Pay
- Bank transfer based on an advance (proforma) invoice — one-time orders only
Payment is required in advance — goods are dispatched after the payment is credited to the seller's account. Cash on delivery is not available.
The payment gateway Stripe Payments Europe, Limited (registered office: Block 4, Harcourt Centre, Harcourt Road, Dublin 2, Ireland) processes card payments in accordance with the PCI DSS Level 1 standard.
AINI subscription: an optional recurring-delivery mode with a 30, 45 or 60-day cadence (selected on the product page). Subscriptions can only be paid by card. Billing happens automatically on the renewal date. The subscription can be cancelled at any time effective at the end of the current period in the Stripe customer portal (we will send the link by e-mail on request).
5. Delivery terms

Shipping is free for orders over 499 CZK.
The delivery period starts when the payment is credited. The risk of damage to the goods passes to the buyer upon receipt of the shipment. The buyer must inspect the shipment on receipt and report any damage to the carrier immediately.
6. Withdrawal from the contract
The buyer has the right to withdraw from the contract without giving a reason within 14 days of receiving the goods (Section 1829 of the Civil Code).
Exceptions to the right of withdrawal (Section 1837 of the Civil Code):
- Goods in sealed packaging that were removed from the packaging after delivery and cannot be returned for hygienic reasons (Section 1837(f)) — i.e. opened cans cannot be returned
- Perishable goods or goods with a short shelf life
Unopened cans in their original packaging can be returned within the 14-day period.
To withdraw, use the model form (see annex) or contact us at info@drinkaini.com. Send the goods to DrinkAINI s.r.o., Rebovka 757/18, Bosonohy, 642 00 Brno, Czech Republic. The money will be refunded within 14 days of receiving the returned goods, using the same payment method.
The cost of returning the goods is borne by the buyer.
7. Complaints and liability for defects
The seller is liable to the buyer for defects in the goods at the time of receipt.
Special provisions for food products:
- The warranty period for food products is at least 8 days from receipt, but no longer than the best-before date stated on the packaging
- Complaints must be raised without undue delay after the defect is discovered
Submit complaints by e-mail to info@drinkaini.com with a description of the defect and a photo. The seller will decide on the complaint within 30 days of its submission.
The buyer is entitled to:
- Delivery of new goods free of defects
- A reasonable discount
- Withdrawal from the contract (if the defect is material)
8. Limitation of liability
The seller is not liable for damage caused by improper use of the product, failure to follow the recommended storage, or use after the expiry date.
Warning: The AINI drink contains caffeine. The product is not intended for children or pregnant and breastfeeding women. Read the composition on the packaging before consumption.
9. Copyright
All e-shop content (texts, graphics, photographs, logos, design) is protected by copyright and is the property of the seller. Any copying, distribution, or other use without prior written consent is prohibited.
10. Dispute resolution
Disputes between the seller and the buyer may be resolved out of court through the Czech Trade Inspection Authority (ČOI) as the alternative dispute resolution (ADR) body.

The buyer has the right to approach the ČOI with a proposal to initiate out-of-court dispute resolution if the dispute cannot be resolved directly with the seller.
11. Special provisions for food products
The seller is obliged to comply with Regulation (EU) No 1169/2011 on the provision of food information to consumers.
Product information:
- The complete composition and list of allergens is stated on the packaging of each can
- Nutritional information is stated on the packaging in accordance with applicable legislation
- The best-before date is stated on the bottom of the can
Mandatory labelling under Regulation (EU) No 1169/2011: “High caffeine content. Not recommended for children or pregnant or breastfeeding women (22.7 mg/100 ml).” One can (330 ml) contains 75 mg of caffeine.
Storage: Store in a dry place at 5–25 °C. Consume immediately after opening.
12. Final provisions
These Terms take effect on the date of their publication. The seller reserves the right to amend the Terms — buyers will be informed of material changes by e-mail.
Legal relationships not governed by these Terms are governed by Czech law. For consumers from EU countries, the choice of Czech law does not deprive them of the protection afforded by the law of their country (Rome I Regulation).
If any provision of the Terms is invalid or ineffective, the remaining provisions are not affected.
